Terms And Conditions

These terms will need to be agreed upon before we work together and are here to protect everyone involved.Any variation to these terms must be jointly agreed in writing before the commencement of any work. These terms and conditions apply whether or not you intend to make use of the materials I have supplied.

Payment

For projects under £500, full payment is required before the commencement of any work. For projects over £500, I will require a non-refundable 50% deposit, to be paid before work commences.

Payments are to  be made by electronic transfer/BACS only.

The price quoted includes all consultations, advice, and up to 3 complimentary revisions. It does not include any changes you make to the original brief or any revisions made after the final draft has been submitted. I will send the completed final draft to you when the final invoice has been paid.

Late payment

In the case of late payment, an additional fee may be charged. This will be in line with The Late Payment of Commercial Debts (Interest) Act 1998.

Processes

I do not charge for our discovery call. This is usually a 15-minute call to discuss our requirements and see if we would be a good fit to work together. I do not prepare for them in advance or give any advice during the call.

If you are happy with the quotation and would like to go ahead then you will need to confirm this in writing. By doing so you confirm that:

  • a) You are authorised to commission the work (either directly or on behalf of another company, or on behalf of a third-party client), 

  • b) That you have read and understood the terms and conditions laid out on this page.

  • c) That you have agreed to the amount you have been quoted

  • d) You give consent for me to send the invoice for either the upfront payment or a 50% deposit. 

Cancellation and unresponsiveness

Cancellation after the first draft has been submitted will be charged at the full fee.

If you decide to cancel the project after you have commissioned it in writing but before the first draft has been submitted then I reserve the right to charge for any additional hours I have worked on the project that are not covered by the 50% and this will be at an hourly rate of £30 per hour. If during the project I do not receive a response from you within 14 days with any queries I may have about the job being undertaken, then I will consider the project to be abandoned by you. 

The full payment agreed upon in the quote will be payable within 7 days once the invoice has been submitted. This will apply unless we have discussed and agreed on any potential delays or breaks in communication ahead of time.

I will make every effort to complete your project within the agreed timeframe. However, on very rare occasions, I may be unable to do so for reasons beyond my control. Under such circumstances, I shall not be liable for any loss or damages caused to you or your client.

Revisions

Feedback must be agreed upon by all decision-makers and consolidated into one email or one set of tracked changes.

Any revisions will need to be completed before your final invoice is issued and can not be claimed retrospectively. 

Although I will fully proof my work, it is your responsibility to proofread the writing and check that it is factually accurate and free from errors and to report any problems to me at your earliest convenience.

I will require feedback on your first draft within 5 working days unless a later date is agreed in advance. If there is additional feedback after submission of the second draft, I will require this within 3 working days.

The final draft is final. If further changes are required, they will be charged at £30 per hour, with a minimum charge of £30. This will be added to your final invoice.

Copyright and indemnity

Until full payment has been made, the ownership and copyright of my work remain with me.

If my writing is used without my consent, I will take all necessary steps to assert my intellectual rights to ownership of the content I have produced.

I cannot accept liability for ensuring that the necessary rights and permissions to use my work have been granted. This is whether in relation to the use of names, people, trademarks, registered or copyright words or phrases. 

You must confirm that you own the copyright for any written materials you supply, to be included in, or adapted for use in, your project.You must accept full responsibility for the authenticity of any research materials and citations you supply.

I take immense pride in my work and complete it to a very high standard but in the unlikely event that something may go wrong, you agree to indemnify me against:

  • a) any claim for compensation, loss compensation, or damages resulting from the use, inability to use, or reluctance to use the materials I have supplied. 

  • b) Any claim by a third-party client for compensation, loss compensation, or damages resulting from the use, inability to use, or reluctance to use materials I have supplied. 

  • c) Any claim for loss, compensation, or damages arising because the necessary rights, permissions, and releases have not been granted. 

  • d) Any claim over breach of copyright relating to materials you have supplied to me.

  • e) Any claim over factual or statistical inaccuracies in materials you have supplied to me.

Unless you expressly prohibit it, I reserve the right to use the writing within my portfolio on my website: withempathycopy.com .
